1. The case of the complainant in brief is that one representative of O.P came and inspected the T.V of the complainant and found that PCB set of the T.V is damaged and said that to repair it Rs 6,000/- to Rs 7,000/- will be required. He took it for repairing on dt 10.3.2006. But some days after he advised the complainant to replace it with a new PCB which will cost Rs 12,000/-. But the complainant denied and asked him to repair it. Again on 2.8.2006 the O.P stated that Rs 14,000/- or more will be required to repair it. The PCB set and remote is lying till date with the O.P. Neither he is repairing it nor returning it.
2. O.P did not file version in spite of service of notice, nor participated in the hearing of the case. Hence O.P is set expert.
3. We have carefully gone through the materials on record and heard the complainant. Complainant submitted that one representative of O.P inspected his T.V and found that its PCB set is damaged. Complainant asked him to repair it .O.P suggested on dt 10.3.06 vide his job card No. 2608 that Rs 6,000/- or Rs 7,000/- will be required to repair it. The PCB was kept in servicing center of O.P for repair. But some days after O.P advised him to replace it with a new PCB costing Rs 12,000/-, to which the complainant denied and asked the O.P to repair it. But the O.P on dt 2.8.06 vide its estimate No. 22 dt 2.8.06 demanded Rs 14,000/- or more towards repairing the PCB. Till date neither the PCB is repaired by the O.P nor returned because of which the complainant is debarred to see T.V and suffering mental tension. Complainant prays for a direction to O.P to repair the PCB soon without cheating and compensation.

The O.P has received the PCB and remote for repairing from 10.3.2006 but after 3 years till date same is lying with him although complainant is asking him again and again to repair it or return it through his letters dt 7.8.2006 dt. 12.12.2007 and dt 6.2.2008 and also by several telephonic messages. The letter of the complainant dt 7.8.2006 to O.P makes it clear that initially the O.P estimated Rs 6,000/- to Rs 7,000/- for repairing the PCB but gradually the O.P kept on increasing the cost of repair. By his letter dt 2.8.2006 the O.P informed the complainant that “after initial inspection of your PCB, the estimate cost of repair will be more than Rs 14,000/-“. But earlier the complainant was informed that the cost towards replacement of the PCB net will be Rs 12,000/-. And suddenly O.P demanded Rs 14,000/- and more towards repairing it. Complainant did not agree to replace it and asked the O.P to repair it sending it to a better servicing center. O.Ps letter dt 2.8.2006 also makes it very clear that the PCB set of T.V does not need replacement and that it can be repaired. But with a maladies intention the O.P is trying to cheat the complainant by increasing the cost towards repairing day by day without even repairing the PCB which is lying in his service center from dt 10.3.2006, for more than 3 years now. This amounts to gross deficiency in service on the part of the O.P due to which the complainant suffered tension.
Hence ordered;
O.P is directed to repair the PCB set to the satisfaction of the complainant charging Rs 14,000/-(Rupees fourteen thousand only) as estimated by him first on dt 10.3.2006 and also pay Rs 2,000/-(Rupees two thousand) only, towards cost and compensation to the complainant, within one month of receipt of this order.
