O R D E R:
Arguments heard. However, at this stage the learned counsel for the OP, has made a statement duly reduced into writing and signed by him that the OP-Company, is, ready and willing to pay Rs.5,000/- in lump sum to the complainant, in full and final settlement of the claim, as involved in this complaint, besides litigation cost of Rs.1500/-. The learned counsel for the complainant has, also made a statement at bar, that the offer given by the OP-Company, is acceptable to the complainant.
In the light of the above, the complaint is disposed of with a direction to the OP-Company, to pay a total sum of Rs.6500/- to the complainant, within a period of forty five days, after the date of receipt of copy of this order, failing which the OP-Company, shall also be liable to pay interest on the aforesaid sum, at the rate of 9% per annum, with effect from the date of filing of the complaint, i.e. 24.06.2008, till actual payment is made. The statement of the learned counsel for the OP, shall also form part and parcel of this order. Hence, the complaint stands disposed of in the above terms.
The learned counsel for the parties undertook to collect the certified copy of this order from the office, free of cost, as per procedure. The file after due completion, be consigned to record room.
