Smt. B.Mohapatra,Lady Member :- The case in brief is as follows;
The complainant is the proprietor of M/s Ayush Enterprises and the O.P is the proprietor of M/s Tibrewal Automobiles. The complainant had purchased one “YAMAHA GLADIATOR” motor cycle from O.P by paying the down payment of Rs.5490/-. On dt.20.02.08, and Rs. 10,000/- on dtd.18.12.2008 which is sworn on money receipt no.190 and 189 respectively and also a D.D from Bank of India of Rs.48,000/- on dtd.20.02.08 sworn in money receipt no. 191. On perusal of all the documents no such evidence has found to prove the payment of Rs.48,000/- on cash to O.P by the complainant. Only amount of Rs.53,490/- has been paid to the O.P towards the cost of bike, accessories, insurance and registration charges.

The Hon’ble Forum is not satisfactorily convinced by the plea taken by the complainant . Hence this case has been dismissed without any cost or compensation thereof. No further case can be maintainable against the O.P., hence order accordingly.
Accordingly the case is disposed off.
