Dt.05/05/2008. Parties present through Advocate. Advocate for Ops filed version. Copy for Complainant is attached. OP’s petition Dt.04/02/2008 seeking modification of Order Dt.25/01/08 passed by the Forum taken up for consideration. The Complainant has filed certified copy of I.C.C. No.11 of 2008 filed in the Court of S.D.J.M., Bargarh against the Ops as regards the matter of the present case. The Complainant explains the delay in filing the I.C.C. Case. The I.C.C. Case lends credence to the case of the Complainant. In the circumstances OP’s petition for modification of Order Dt.25/01/2008 stands rejected.
Complainant’s petition U/S 27 of the C.P.Act Dt.06/02/2008 and the Ops’s objection Dt.18/02/2008 taken up for consideration. Perused the petition and objection thereto. Ops’s plea that a petition U/S 27 of the C.P.Act is not tenable during the pendency of the case, holds water. Hence Complainant’s petition U/S 27 of the C.P.Act is rejected.
The Ops is directed to comply with the Order Dt.25/01/2008 passed by this Forum and report compliance on Dt.16/05/2008.

Dt.22/01/2009. Case record put up to-day on the basis of the put up petition filed by the Complainant through his Advocate. Copy served.
Complainant files original copy of revision petition R.P. No. 38 of 2008 and expresses his readiness to pay the amount as directed in the Order of R.P. No. 38 of 2008 by the Hon’ble State CDR Commission, Cuttack. The Complainant submits that he has received the State CDR Commission Order yesterday i.e. on Dt. 21/01/2009.
Heard the Advocate of both the parties on the petition of the Complainant.
The Hon’ble State Commission in their Order Dt. 01/10/2008 in R.P. No. 38 of 2008, have directed the present complainant to deposit a sum of Rs. 10,000/-(Rupees ten thousand)only with the OP/Region petitioner, with in a period of fifteen days and on receipt of the said amount the Revision Petition ICICI Bank shall release the vehicle in favour of the Complainant.
Now, more than three months have already elapsed from the stipulated date of payment as ordered by the Hon’ble State Commission in the said revision petition. This Forum has no authority to modify or interfere in the order of the Hon’ble State CDR Commission. The Complainant can approved the Hon’ble State CDR Commission with his prayer as made in this petition.
In view of the Order of the Hon’ble State Commission in R.P. No. 38 of 2008, the present Complaint is closed.
Complaint disposed of accordingly.
