Deficiency in service is the complaint of the complainant.
1. In brief the case of the complainant is that he wanted to open a Saving Bank Account in his name and accordingly approached the O.P who is the Branch Manager ICICI Bank Sundargarh Branch. The complainant on dt.27.05.09 gave a cheque amounting to Rs.25,200/- to SBI Sundargarh Branch bearing No. 469152 to the O.P. The said cheque was presented for collection and it was duly collected on dt.29.05.09 by the O.P. At the time of presentation of the cheque the O.P gave a Account No. 087601500555 a cheque book and a ATM Card to the petitioner. But till the filing of the case the Bank account has not been opened in the name of the petitioner. In the meantime the petitioner has been to the bank several times requesting the O.P for opening of the Account in his favour but all the times the O.P assuring to open the Account Book in favour of the complainant. Due to such action of the O.P the complainant is not able to operate the accounts and also loosing interest on his deposited amount for which the complainant has filed this dispute case with a prayer for a direction to the O.P to open a Saving Account in

his favour and the interest of the deposited amount from dt.29.05.09 to till opening of the accounts be credited in favour of the complainant and to pay Rs.30,000/- as compensation for harassment and mental agony.

The O.P. appeared through his learned Advocate and submitted the written version wherein it has been stated that the complainant approached the O.P for opening of a Bank Account in his bank and on dt.27.05.09 he deposited Rs.25,200/- drawn on State Bank of India sundargarh and the amount was collected by the O.P on 29.05.09. The amount so collected on dt.29.05.09 was duly accounted to the credit of the complainant on dt.30.05.09 and the account with O.P become operative from dt.30.05.2009.
Further it has been stated that the complainant withdrawn an amount of Rs.10,000/- on dt.06.07.09 and also subsequent dates and appearing his account and prayed for the dismissal of the case as there is no deficiency in service on the part of the O.P.
3. Heard the learned advocates appearing for both the parties and perused the documents as filed by the parties in their support. We have gone through the case in detail. It is not disputed that the complainant opened a Saving Account in the ICICI Bank and deposited a cheque amounting to Rs.25,200/- on dt.27.05.09 which was collected by the O.P on dt.29.05.09 which was collected by the O.P on dt.29.05,.09 and it was credited in the Account of the complainant and the account was operateive from dt.30.05.09. But the complainant submitted that till the failing of the case on dt.26.06.09 there was no account with the O.P in his favour for which he had requested the O.P time and again to open the account.
The O.P submitted a statement of account wherein it is clearly that the account in favour of the complainant was opened on 30th may 09 and it is operative from that date.
4. Thus under the circumstances we find no merit in the case and case is dismissed.
The case is disposed off accordingly.
